Do mortgage papers list the terms of foreclosure proceedings?

If I go through foreclosure, I want to know what happens such as what happens to the balance of the mortgage owed. My mortgage is with Citimortgage and it is A paper fixed 30 year from a few years back if that makes any difference to anyone who may know. I lost my job and it’s only a matter of time before I lose my house, which is worth 40% of my mortgage balance so I don’t have the option of selling. Please help I am stressed out beyond words to describe it.
I regret all the home improvements I made – adding baseboards, hardwood floors, ceiling fans, remodeled kitchen. What a waste of money to say the least. I really don’t know how to get over this or what to expect.
Not to mention all my savings I had put into the downpayment. It’s like everything I worked for is going to get handed to the bank. They get a free house, how nice. They are benefiting the most in this economy so why are they the ones who are getting the billions and not us?
The home is worth about 160K and my mortgage balance is about 385K.

My mortg pymt is about $3200/month including taxes. I don’t have anybody to move in with and there’s no way it would ever get rented close to that, I saw one place nearby listed for rent at $1500.

Mortgage papers usually list the foreclosure process in case of a default. But unless you are a real estate professional it will be very hard to understand the terminology. Typically when you stop making payments the mortgage company will contact you with options, or with a time line of the foreclosure process. I strongly suggest that you contact a Realtor. You have several options. Losing your property should not be one of them, you have invested so much. Consider a short sale, in this case the bank allows you to sell your property for market value, and forgives the difference or balance owed due to your financial hard ship. This helps you avoid foreclosure and saves your credit. Look into all your options and make an informed decision.

How do I attain a home that’s in foreclosure?

This is the situation:

My father’s home is in foreclosure and it probably foreclose within a week. I would like to know how I can attain the home and recieve a home loan. I do not have anything for the down payment. I’m 20 years old and have no credit history though I have friends who would be living with me in this home with remarkable credit. Also, if I can get the home after it’s foreclosure, does my father have to sign anything to me? Really need help. Thank you.
I live in Los Angeles County btw.

if you let the foreclosure process get to the point where the bank takes it back, you can investigate when it will be up for sale at the local court house. However, you have an upper hand, as you know it is being foreclosed on. My suggestion is that you contact the bank whom has the mortgage on your dads house. The bank do not want to take back the house, as it is bad debt on their books, and the bank most likely have alot of bad debt already. Try and negotiate with the bank to take over your dads payments, or even negotiate a monthly payment the bank determines you can afford. In short contact the bank, come to an agreement with them how much you can afford (bring your pay stubs & W2’s), and I would think the bank wants to work with you. Worst case senario, buy the property under the HUD program that allows you to put down only 500 $.

what do you do if your renting at an apartment complex in foreclosure?

Bethany Group management company is going into foreclosure- I hear filing bankruptcy too. What do you do if you are a tenate at one of their communities? I have a friend who is in this situation- she asked me because I work in property management but I have never delt with this type of situation before so I couldn’t help her.

I would stay and pay the rent as usual because if the apt sales or gets foreclosed on whom ever holds the title will want tenants there it will be easier to sale rented property with ready tenants than having to rent them out after the sale and even foreclosures will either be for sale or auction off sooner or later if they didn’t say move I would hang in there

How Soon Can I Take Out a Home Equity Loan or Refinance After a Cash Purchase of a Foreclosure?

The house is only 10k. So if I pay 10k cash, how fast can I do a home equity loan for that 10k? I need to make repairs as it is a foreclosure in poor condition. Can I do a refinance loan and get more than I even paid for it if it appraises higher than 10k, which it will? Thanks for any help

It all depends on the difference in the value of the place and the amount owed on the loan – that is what’s considered your equity. Many banks will only loan up to about 80% of the equity, but a few go higher. For example, lets say you owe $50,000, but the place is worth $60,000, then you have $10,000 in equity. Take 80% of that and you have about $8,000 you could loan against.

Right. What made me actually write this was a number of years ago I had been working with people in foreclosure for years, and it was just a way to let them know what was going to be going on once the foreclosure was filed against them. Now in many cases, these people were already experiencing what was going on.

And again I’ve recently had a friend or two go through foreclosure and I had them collect all of the paperwork that they got from all of the foreclosure guys out there trying to help them sell their house or do whatever it was, and I was surprised at how thin the stack was. This one gal in particular, lives in Scottsdale in a very nice house and she didnt have more than maybe 6 letters. In the past, a couple of years ago, especially at the peak of the market, when somebody was in a foreclosure situation they would have seriously a stack 6 inches thick.

People would be knocking on their door 24 hours a day, calling them, dropping off stuff. There were cars driving by all the time and it really got to be a nuisance. And frankly I think it hurt the home owner and their standing in a neighborhood, with all of that traffic and of course everybody knew that they were having problems. So that is why the report was originally written and why I wanted to talk about it today because of all the foreclosures going on in the market right now.

Now let me ask you a question, you are saying that two years ago if I were in a foreclosure my mail box would be chock-full of marketing products. Youre telling me now that there is virtually none?

Well I think that part of it is that back then there was financing available to be able to come in and refinance the people. I certainly myself did dozens of loans, at least, to bail people out of bankruptcies and foreclosures, and also people had equity back then. Property values were continuing to go up. I forget how many scams I pointed out here in the book, I think there are 18 or something in here, and most of them are essentially people attempting to get your house away from you, either refinance it, sell it for you, take a lease option, there are all kinds of different scams involved, but I think the reason we see so much less of it today is because there is so much less equity. So if you are upside down by $300,000 in your house, i dont care how good of a scammer you are, you are not going to make a lot of money off that.

But there are a couple of scams going on right now that I want to talk about because there are a couple of things that happened just recently that harkened me back to when I first got started in real estate here in Arizona in the late 1980s. I was selling repos for Fannie Mae, Countrywide, and the Resolution Trust Corporation, which was in charge of selling off all of the real estate owned for the 1,800 or so Savings and Loans that failed in the late 1980s early 1990s. There were so many scams going on then, I mean we had just tons of vacant houses we were selling, and one of the big scams that I thought was actually being perpetrated on a friend of mine the other day is a little something known as rent skimming… http://realestatemarketingthisweek.com
