Acermill is 100% correct. I would just add that if you plan to buy a foreclosed home, you need to know that you must have mortgage approval before you can submit an offer to buyer. FNMA will not look at an offer if mortgage approval or proof of funds isn't included with the offer.

By the way, it won't cost you anything to work with a Realtor because the commission is paid by the seller.

Regardless of how you find foreclosed properties, you will end up dealing with real estate agents anyway. The only lenders who will deal directly with buyers are smaller local banks which have kept the mortgage "in house" and have not resold the loan.

The big lenders (Wells Fargo, Bank of America, Deutsche, etc.) all dispose of their foreclosures through local area real estate brokerages. While you can find lists of their owned properties on their websites, you will be directed to the listing agency for further interest. Understand that over 95% of foreclosed properties are handled by real estate agencies.

The nationwide lenders simply do not want the hassle of dealing with buyers in fifty states, all of which have varying degrees of differences in real estate rules, documents, etc.
References :
i'm really sorry to hear about your situation, that sucks. i would recommend speaking with a lawyer about your options.

if you really want to keep your home, is there any possibility that you could rent it out while you stay with relatives for a while?
References :
if you let the foreclosure process get to the point where the bank takes it back, you can investigate when it will be up for sale at the local court house. However, you have an upper hand, as you know it is being foreclosed on. My suggestion is that you contact the bank whom has the mortgage on your dads house. The bank do not want to take back the house, as it is bad debt on their books, and the bank most likely have alot of bad debt already. Try and negotiate with the bank to take over your dads payments, or even negotiate a monthly payment the bank determines you can afford. In short contact the bank, come to an agreement with them how much you can afford (bring your pay stubs & W2's), and I would think the bank wants to work with you. Worst case senario, buy the property under the HUD program that allows you to put down only 500 $.

Mortgage papers usually list the foreclosure process in case of a default. But unless you are a real estate professional it will be very hard to understand the terminology. Typically when you stop making payments the mortgage company will contact you with options, or with a time line of the foreclosure process. I strongly suggest that you contact a Realtor. You have several options. Losing your property should not be one of them, you have invested so much. Consider a short sale, in this case the bank allows you to sell your property for market value, and forgives the difference or balance owed due to your financial hard ship. This helps you avoid foreclosure and saves your credit. Look into all your options and make an informed decision.
References :
10yrs of practicing Real estate in southern california.

It depends what state you live in, as well as what county you live in. You should contact your county's department of finance. If your county allows it you will be able to purchase your father's tax deed by paying for the taxes he owes plus some additional fees. If he cannot pay the money back in a certain amount of time 2-10 years I believe, the deed to the house is yours.
References :
Heck in this ...
Heck in this economy people will do everything to get what they want even to show a lesson to real estate that foreclosing peoples home is considered wrong if they cant pay the mortgage due to the ridiculous pay hike keep going up every year.

Burn them all down real estate will get the message. Hooray for the Arson's who burned down these foreclosed homes.
